This past April, the Maryland General Assembly passed a law that empowers police officers to pull over distracted drivers who are visibly on the phone or text messaging. This is part of the state’s goal to crack down on the number of accidents caused by drivers who are not paying attention.
As the law now stands, police may pull over and issue a ticket to any driver for the sheer act of speaking on a cell phone while the car is moving. This is different than the previous iteration of this regulation, which only allowed law enforcement officials to pull over distracted drivers if they were also suspected of another crime. This legal distinction is important because it allows car accident victims to show negligence if the driver was on the phone at the time of the cash.
