Two Types of Claims
Although most people only recognize the term "wrongful death" — often, two distinct claims will be filed in connection with these cases. The first, the wrongful death claim, is brought by family members seeking compensation for damages such as loss of consortium, loss of support and loss of expected financial contributions the deceased would have made to the family had they lived.
The second type of claim is known as a survival action. A survival action is generally brought on behalf of the decedent's estate by the estate's executor or personal representative. Compensation in these cases is for the pain, suffering and other losses suffered by the victim himself or herself. Survival claims are not allowed in cases where it is judged the victim died instantaneously.
